On 6 December 1937, in Bradford county, Pennsylvania, he was convicted of receiving stolen goods and received a prison sentence of from one year six months to three years. On 24 June 1938 he entered Western State Penitentiary in Pittsburgh to begin serving his sentence. The only personal information on his record of receipt was that he had no cash or valuables and weighed 134 pounds.
